THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.


Our Commitment to Your Privacy

Cahaba Center for Mental Health is required by law to maintain the privacy of your protected health information (PHI), to provide you with notice of our legal duties and privacy practices with respect to your PHI, and to notify affected individuals following a breach of unsecured PHI. We are required to abide by the terms of this Notice while it is in effect.


How We May Use and Disclose Your Health Information

The following describes the ways we may use and disclose health information that identifies you (“health information”). Not every use or disclosure in a category will be listed, but all of the ways we are permitted to use and disclose information will fall within one of the categories.

Treatment. We may use or disclose your health information to provide, coordinate, or manage your mental health treatment and any related services. For example, a physician treating you for a physical condition may need to know about medications you are taking.

Payment. We may use and disclose your health information so that the treatment and services you receive at our center may be billed to and payment may be collected from you, an insurance company, or a third party. For example, we may need to give your health plan information about therapy you received so your health plan will pay us or reimburse you for the therapy.

Health Care Operations. We may use and disclose your health information in connection with our health care operations. Health care operations include quality assessment and improvement activities, reviewing the competence or qualifications of health care professionals, evaluating staff performance, conducting training programs, accreditation, certification, licensing, or credentialing activities.


Uses and Disclosures That Require Your Authorization

Psychotherapy Notes. We will obtain your written authorization before using or disclosing psychotherapy notes about you, except in limited circumstances permitted by law.

Marketing. We will obtain your written authorization before using or disclosing your health information for marketing purposes, except as otherwise permitted by law.

Sale of Health Information. We will obtain your written authorization before selling your health information.

You may revoke any authorization you have given us at any time by submitting a written request to our Privacy Officer.


Other Uses and Disclosures

We may use or disclose your health information in the following circumstances without your authorization:

  • As Required by Law — When disclosure is required by federal, state, or local law.
  • Public Health Activities — To public health authorities for activities such as disease reporting.
  • Abuse, Neglect, or Domestic Violence — To government authorities authorized by law to receive reports of abuse, neglect, or domestic violence.
  • Health Oversight Activities — To a health oversight agency for activities authorized by law.
  • Judicial and Administrative Proceedings — In response to a court order, subpoena, discovery request, or other lawful process.
  • Law Enforcement — To law enforcement officials for limited law enforcement purposes.
  • Serious Threats to Health or Safety — To prevent or lessen a serious and imminent threat to the health or safety of a person or the public.
  • Workers’ Compensation — To comply with workers’ compensation laws and similar programs.

Data Privacy Event Notice

In accordance with applicable law, Cahaba Center for Mental Health has issued a Notice Regarding a Data Privacy Event. If you believe your information may have been affected, please review the notice available at our office or contact our Privacy Officer.


Your Rights Regarding Your Health Information

Right to Inspect and Copy. You have the right to inspect and obtain a copy of your health information, including medical and billing records, used to make decisions about your care.

Right to Amend. If you feel that health information we have about you is incorrect or incomplete, you may ask us to amend the information for as long as we maintain it.

Right to an Accounting of Disclosures. You have the right to request an accounting of disclosures we have made of your health information, other than those made for treatment, payment, or health care operations.

Right to Request Restrictions. You have the right to request a restriction or limitation on the health information we use or disclose about you for treatment, payment, or health care operations.

Right to Request Confidential Communications. You have the right to request that we communicate with you about medical matters in a certain way or at a certain location.

Right to a Paper Copy of this Notice. You have the right to a paper copy of this notice. You may ask us to give you a copy of this notice at any time.

Right to be Notified of a Breach. You have the right to be notified following a breach of your unsecured protected health information.


Sliding Fee Discount Program

Cahaba Center for Mental Health offers a Sliding Fee Discount Program to qualifying individuals. No one is denied services due to inability to pay.


Changes to This Notice

We reserve the right to change this notice. We reserve the right to make the revised or changed notice effective for health information we already have about you as well as any information we receive in the future. The current notice will be posted in our facility and on our website.


Complaints

If you believe your privacy rights have been violated, you may file a complaint with Cahaba Center for Mental Health or with the Secretary of the Department of Health and Human Services. To file a complaint with us, contact our Privacy Officer. All complaints must be submitted in writing. You will not be penalized for filing a complaint.
